When income is over the cap

The Miller Trust (Qualified Income Trust)

If gross monthly income is even $1 over Texas’ $2,982 cap, the state computer denies the application automatically. The fix is a simple bank account with a specific title — the Miller Trust.

How it works, in plain English

  1. 1
Open a new checking account at a Texas bank.

It must be titled exactly: "[Applicant's Name] Qualified Income Trust." The applicant cannot be the trustee — a family member or caregiver signs.

  2. 2
Each month, route income into the QIT.

Social Security, pension, VA — the gross income flows into this account, not into a personal account.

  3. 3
The trustee pays bills from the QIT each month.

Personal needs allowance, Medicare premiums, the community spouse's monthly allowance, then the nursing facility.

  4. 4
    End every month at $0.00.

An empty QIT is the proof that all income was properly used. Even $20 left over can risk eligibility.

Take this to the bank

A one-page instruction sheet for the bank teller or manager. Pre-filled with the applicant’s name and the exact account titling Texas HHSC requires.

Red-flag scanner

  • High balance. If the QIT ends the month above $20, eligibility is at risk.
  • Wrong deposit. Tax refunds, gifts, or sale proceeds do not belong here — only monthly income.
  • Missed month. If no deposit posts by the 25th, coverage for that month can be lost.
